TERMS AND CONDITIONS

When placing bids at Bidson.com these terms are approved automatically.

You have to be over 18 years old to participate in the auctions.

AUCTION POLICY

The market price of the product being auctioned off can be seen in each auction's information text. The market price is based upon an average supplier price and is collected from price information websites such as prisjakt.se and pricerunner.com. Bidson cannot guarantee that you cannot find the product at a cheaper price.

A bid which is placed in an auction is only valid in the auction the SMS prefix or bid account is connected to.

Bids are placed in whole eurocents. When an auction is finished the winning bid is converted to the winning bidder's local currency. In Penny auctions the bids are converted from EURO to GBP using a fixed exchange rate, 1 GBP - 1 EURO. The bidder is debited a service cost for each bid which is placed in the auctions.

The service cost is paid via SMS or in advance using a charge card and cannot be refunded. Bidson's auctions are available in Great Britain, The Netherlands, Germany and Sweden.

For an SMS bid to be valid in the auction a delivery report which confirms that the payment has been made to the operator must be received.

Every bidder/household is only allowed to buy one of each product/article at Bidson.com. This rule came into effect on 13 March 2009.

Bidson reserves the right to disqualify bids and/or users without repaying the bid fee as well as annul the purchase if any of the following occurs:

  • If a user during registration or bidding provides misleading information.
  • If the auction winner fails to pay for his/her bid within 30 working days from the day he/she has been informed about the auction win.
  • If two or several bidders co-operate by exchanging information.
  • If more than one account is created by the same user.
  • If a user uses a user name which can be seen as offensive or insulting to a third party.
  • If a user uses his user name to promote other pages or services.
  • If a user breaks any of the other rules in this contract.

The bids become valid when they enter Bidson's database and our system registers the bid. Please note that the bids are not valid from when they are sent from the mobile or computer. Usually it take approximately one to two seconds for the bid to become valid but on some occasions it may take longer. Bidson takes no responsibility for this delay and its consequences, as it is out of our control. Therefore, Bidson is not responsible for technical problems concerning the telephone operator and/or SMS traffic, e.g. failing to send a SMS.

LOWEST BID AUCTIONS

Bidson aims to advertise an auction result within 6 working hours (from the time when the auction finished).

BID LIMITED AUCTIONS

In every Bid limited auction a maximum number of bids can be placed. The Bid limited auction is finished automatically when the maximum number of bids have been placed. However, Bidson reserves the right to accept more bids than the maximum number of bids in certain auctions due to delays in registering bids. Bidson reserves the right to lower the number of bids in the auctions. This is to speed up the auction. However, Bidson is not allowed to raise the maximum number of bids in an auction.

TIME AUCTIONS

There is no maximum limit on the number of bids you are allowed to place. When delivery reports are missing when the auction finishes, we will wait for the bids which might influence the outcome of the auction. The countdown timer is connected to the server clock and is therefore an absolute indicator of how much time of the auction remains.

PENNY AUCTIONS

A Penny auction is finished when no new bids have been placed n minutes after the latest bid was placed. n represents the bid time which is set for each auction.

Every auction has a countdown timer which shows how much bid time in whole seconds rounded down remains from the time the latest bid was placed. The countdown timer is continually synchronized with Bidson's servers as far as the user's connection allows this.

Bidson cannot be held responsible for interruptions in the user's connection and the errors that may arise due to this. This includes, but is not limited to: the timer counting down incorrectly, out of date information about the bidder and bid.

Bidson reserves the right to pause all auctions when we suspect operational disturbances. Bidson reserves the right to change the bid time during ongoing auctions and open closed auction when we suspect operational disturbances.

In Penny auctions we wait two seconds after the bid time has reached zero for SMSes to arrive. This is because of the normal delay in the SMS computer net.

CHICKEN RACE AUCTIONS

Bids and calling prices in auctions are converted into each country's currency at a fixed exchange rate. The exchange rate may vary from one auction to another, and is determined by Bidson on the same day that the auction is published.

No bids are retracted or repaid once the entry fee for one or more auctions has been paid.

PAYING FOR A WON AUCTION

A winning bid is binding. Binding contracts arise between Bidson and the bidder who is the approved winner of the auction.

After the auction is finished it is the responsibility of both Bidson and the buyer to ensure that the purchase is fulfilled. It is Bidson's responsibility to contact the winner of the auction and receive the invoice.

Terms of payment for invoices of winning bids and shipping is 30 days.

In those cases when the bidder does not meet his liability to pay Bidson the winning bid is cancelled. The auction winner pays for shipping/handling.

CONTACTING THE WINNER

Bidson contacts the winner within 24 working hours after the auction has finished. If Bidson is not able to contact the winner and the invoice is not paid within the fixed expiration (30 days), Bidson reserves the right to discontinue the purchase. In accordance with the winner's wishes, Bidson can act as an intermediary between media and the auction winner.

DELIVERING A PRODUCT OR SERVICE

Normally, the products are delivered within 5 - 8 working days. Bidson cannot be held responsible for any delays of product delivery caused by a subcontractor. In rare cases a product which is auctioned off at Bidson can run out or no longer be in the subcontractor's stock. In such cases Bidson has the right to replace this with a similar product of an equal value. Bidson cannot be held responsible for delays caused by the post or other suppliers.

Bidson’s suppliers offer a 1 year manufacturer’s warranty unless otherwise specified.

RESPONSIBILITY

Bidson is not responsible for any proof- or spelling mistakes regarding products or where the bidder loses data or where a bid has been distorted or not arrived. Bidson is free from responsibility if processing obligations are hindered or made more difficult due to circumstances beyond our control which we could not reasonably have expected to foresee.

Normally, the service is in operation 24 hours per day, seven days a week. The service may encounter operational disturbances. Bidson reserves the right to postpone dates and times for finishing an auction after unforeseen operational disturbances. Included are, but not limited to, errors in the Internet connection to the server, unauthorized access to computer systems, service interruptions at the supplier and force majeur.

Therefore, Bidson is not responsible for any overload of the website and any arising consequences. Bidson is not responsible for damage or error in our or other computer equipment and/or programmes which influence the participation in Bidson's auctions. Bidson is not responsible for changes in legislation which affect the auction and its realization.

CARD, INVOICE OR DIRECT PAYMENT

Bidson is not responsible for any technical error at the supplier of payment solutions. Bidson is not responsible if the bidder fails with a transaction. If an error should occur in a transaction it is the responsibility of the bidder to inform Bidson immediately.

RIGHT OF WITHDRAWAL

You have the right of withdrawal within 14 days from the date of the purchase. Bidson will then refund the price for the bid credits that remain unused.

Your right of withdrawal expires prematurely if you have started with use of the service before the end of the withdrawal period, this means using a bid credit to make a bid in any of Bidsons auctions.

BID CREDIT EXPIRATION POLICY

Bid credits expire 90 days after your last purchase or participation in an auction. You can extend the period by making one single bid. This automatically extends the period for another 90 days.

COMPENSATION CLAIMS

Bidson's subcontractors are responsible for that all products are delivered with a guarantee.

Bidson is not a retailer of the goods which are auctioned off and therefore is not responsible for guarantees and compensation claims. During compensation claims and guarantee cases the auction winner is referred to the retailer in question. However, Bidson is responsible for putting the parties into contact with one another.

HANDLING PERSONAL PARTICULARS

All registered personal particulars are handled with the utmost secrecy and can at the user's request be removed from Bidson's database in connection with cancellation of a membership.

Bidson uses collected personal particulars only to be able to contact bidders when they have won, because of operational disturbances or to market Bidson's own services. The user has the right to decline this by ending their membership at Bidson. Bidson reserves the right to publish the winner's Christian name and surname.

TRANSFER OF RIGHTS

Bidson reserves the right to transfer all or parts of the rights and responsibilities which are made clear in these general terms. During a transfer we will inform you under general terms of who has taken over the rights and responsibilities. The bidder does not have the right to transfer rights or responsibilities in accordance with these Terms.

DISPUTES AND APPLICABLE LAW

English law is applicable to these Terms, as it is applied to contracts which have been agreed upon in England between English parties. Disputes regarding validity, interpretation, applicability or application of these Terms and out of those originating legal relations, shall be settled by a common court in England.

CHANGING TERMS

Bidson reserves the right to change these terms during ongoing bidding. The new terms come into force upon being published.

OTHER ITEMS

Abuse of these general terms will lead to disqualification, i.e. the bid of the person concerned will be annulled and any purchases cancelled.
